JUSTICE SANDEEP KUMAR ORAL ORDER 08-02-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in connection with Baheri P.S. Case No. 66 of 2021 registered for the offence punishable under Sections 147, 148, 149, 341, 323 and 307 of the Indian Penal Code later on added offence punishable under Section 302 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that this is a case of sudden provocation and, therefore, his bail should be reconsidered.

The petitioner is one of the assailants of the deceased.

The learned counsel for the petitioner has further submitted that another co-accused having same and similar

No.70799 of 2022(4) dt.08-02-2023 2/2 allegation has been granted bail, but on being asked whether the order of this Court was produced before the learned Judge hearing the bail application of another accused he fairly submits that this order was not produced before the learned Judge who has granted bail to the another co-accused.

In these circumstances, I am not inclined to review my earlier order.

This application is again dismissed.

Learned trial Court is directed to conclude the trial at the earliest.
