2. The petitioner has prayed for bail in connection with S.T. No. 209 of 2024 arising out of Bariyapur P.S. Case No.100 of 2023 registered for the offence punishable under Sections 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act.

3. The case of the prosecution case is that the informant was sitting at his tea shop, at that time Shreenath Yadav arrived and started abusing him and fired at him due to which the informant received gun shot injury in his right shoulder and he fell down.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.77478 of 2024(3) dt.24-01-2025 2/2 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. There is no repeation of blow. The offence happened at the spur moment of time. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Petitioner is languishing in judicial custody since 28.07.2023.

5. The application for bail is opposed by learned APP for the State and submitted that as per injury report, nature of injury is grievous.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case , this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-V, Munger in connection with S.T. No. 209 of 2024 arising out of Bariyapur P.S. Case No.100 of 2023.
