JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-05-2018 The petitioner is apprehending his arrest in connection with Darbhanga Sadar (O.P. Bhalpati) P.S. Case No. 287 of 2017, registered for offences punishable under Section 392 of the Indian Penal Code.
Allegation against the petitioner and other accused of this case is of committing loot of Rs. 92,000/- and mobile and other articles from the informant.
It has been submitted on behalf of the petitioner is not named in the F.I.R. and his name has been dragged in this case only on the basis of confession and except, there is nothing against him.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.27469 of 2018 (2) dt.10-05-2018 2/2 circumstances of the case as well as the criminal antecedent of the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather this application is disposed of with direction to the petitioner to surrender before the court below and pray for regular bail, which will be considered on the basis of merit of the case and the court below shall pass an appropriate order, if possible on same day, without being prejudiced by the order of this Court.
