The petitioner apprehends his arrest in connection with CC Case No. 16 of 2018 for the offences registered under Sections 5, 8, 9 and 10 of the Bihar Wood Chiran Regulation Act, 1990 and Sections 41, 42 and 52 of the Forest Conservation Act.
The allegation is regarding the informant of this case i.e. the Forest Range Officer, Kishanganj, having discovered that one illegal wood saw mill was running near by Lohagara Hat at Bahadurganj and when he reached at the spot, the petitioner herein, alleged to be the owner of the said saw mill, had fled away.
The learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.65200 of 2019(3) dt.16-11-2019 2/2 neither the saw mill belongs to the petitioner nor the land over which the saw mill has been constructed, belongs to the petitioner and the petitioner has got no connection with the same. The petitioner is stated to be having a clean antecedent. Having regard to the facts and circumstances of the case, the petitioner, above named, in the event of his arrest/surrender before the court below within a period of four weeks from today, is directed to the released on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with CC Case No. 16 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
