This application, for grant of anticipatory bail, arises out of Naubatpur Police Station Case No.613 of 2014, disclosing offences under Sections 147, 148, 149, 342, 307 and 302 of Indian Penal Code.
Learned counsel for the petitioners has submitted that the petitioners are innocent and have not committed any offence. In fact, the several co-accused, Anup Yadav, Sharda Kumar @ Shardha Yadav, Munna Yadav and Kishun Yadav, having more of less similar allegations have already been granted anticipatory bail by a co-ordinate Bench of this Court in
Patna High Court Cr.Misc. No.30993 of 2018 (3) dt.05-06-2018 Cr. Misc. No. 11391 of 2018. Hence, the petitioners deserve the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna, in connection with Naubatpur Police Station Case No. 613 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
