Mr.Anant Kumar 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-10-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Shahpur P.S. Case No. 143 of 2019, registered under Sections 341, 323, 379, 307 and 504/34 of the Indian Penal Code.

The accusation is that when the informant, Ajay Saw, returned at his house in the evening of 07.04.2019 then saw that seven persons named in the FIR including the petitioners were abusing to his wife. When the informant made protest then both petitioners caught hold him and assaulted through fist and slaps. At that time, Jitendr Kumar assaulted by

Patna High Court CR. MISC. No.64367 of 2019(2) dt.23-10-2019 2/2 pelting bricks causing injury at his head. Thereafter, he was rushed to the Sub-Divisional Hospital, Danapur for treatment. Learned counsel for the petitioners submits that while the petitioners are named in the F.I.R. but no specific overt act has been attributed against them. Further submission is that petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned ACJM-I, Danapur, in connection with Shahpur P.S. Case No. 143 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
