The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Pachrukhi P.S. Case no. 279 of 2020 instituted for the offence under Sections 302, 201/34 of the Indian Penal Code.

As per allegation in the FIR, the informant alleged that the petitioner along with co-accused persons have committed murder of his son and threw the body in pond in order to conceal the evidence.

Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.73059 of 2023(5) dt.02-05-2024 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated due to dirty village politics. The informant is not an eye witness of the alleged occurrence and there is no specific allegation against the petitioner. Entire allegation hinges around the petitioner merely on the basis of suspicion. Similarly situated co-accused Bimlesh Singh has already been granted bail vide order dated 24.01.2024, passed in Cr. Misc. No. 77341 of 2023 by this Court.

In contra, learned A.P.P., appearing for the State, vehemently opposed the prayer of bail. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Pachrukhi P.S. Case no. 279 of 2020, he will be
