JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 03-10-2017 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the informant. The petitioners seek pre-arrest bail in connection with Saharsa Sadar P.S. Case No. 471 of 2017 registered under Sections 406, 420, 467, 468, 471 and 120B of the Indian Penal Code.
It is contended by the learned counsel for the
Patna High Court Cr.Misc. No.45977 of 2017 (2) dt.03-10-2017 petitioners that a dispute of civil nature has been given colour of criminal case.
He contended that the petitioners are purchaser, deed writer and identifiers of a piece of plot, which was sold for consideration by the complainant, but later on, she has alleged that her thumb impression had been taken forcibly. Learned counsel for the informant has opposed the application for grant of pre-arrest bail to the petitioners. Considering the nature of allegation, in the event of arrest or surrender in the court below within four weeks from today, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 471 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
