JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bhagwan Bazar P.S. Case No. 272 of 2017, registered under Sections 342, 323, 504, 506 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that, on 02.08.2017, when the informant along with his friend Pravej Alam was going on motor cycle then petitioner along with three others intercepted him in the way. At that time, petitioner shot fire at him, in which, he fell down and he did not sustain injury.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that there was dispute in between the

No.47344 of 2017 (2) dt.06-10-2017 informant and the brother of the petitioner due to that reason the informant lodged the present case with false allegation of making firing at the informant, but he did not sustain injury. Moreover, the petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Bhagwan Bazar P.S. Case No. 272 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
