JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-04-2023 The present petition has been filed for restoration of a writ petition bearing C.W.J.C. No.4486 of 2021, which has stood dismissed on account of non-compliance of the peremptory order dated 12.10.2022.
The learned counsel for the petitioner has submitted that on account of certain personal difficulties, the peremptory order of this Court dated 12.10.2022, could not be complied with, hence, the aforesaid writ petition has stood
Patna High Court MJC No.2508 of 2022(3) dt.20-04-2023 2/2 dismissed for default, however, a sympathetic view be taken and the aforesaid writ petition be restored to its original file.
Having regard to the facts and circumstances of the case and considering the averments made in the present petition, I deem it fit and proper to direct for restoration of the aforesaid writ petition to its original file, subject to the registry verifying, regarding compliance of the peremptory order dated 12.10.2022.
The petition stands disposed off on the aforesaid terms.
