Heard learned counsel for the petitioner and learned A.P.P. for the State.

The learned counsel for the petitioner submits that petitioner was granted the privilege of anticipatory bail by an order dated 23-9-2024 in Cr. Misc No. 55139 of 2024 with a condition that one of the bailors of the petitioner shall be his father, apart from other conditions.

It is next submitted that the word "Late" inadvertently could not be prefixed before the name of the father of the petitioner in Cr. Misc No. 55139 of 2024. It is next submitted that a supplementary affidavit has been filed in the instant modification application bringing on record the death certificate of the father of the petitioner and from perusal of the same, it would manifest that father of the petitioner died on 2-8-

In view of the submission made by the learned counsel appearing on behalf of the petitioner, para-6 of the order dated 23-9-2024 is modified to read as - "6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of two weeks from today, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000 /- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul/InchargeSuccessor Court in connection with Supaul P.S. Case No. 02 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C." and para-7 of the order dated 23-9-2024 in Cr. Misc No. 55139 of 2024 is modified to read as - "7. One of the bailors of the petitioner shall be his mother, who has sworn the affidavit, namely, Shanti Devi."

Accordingly, the order dated 23-9-2024 in Cr. Misc No. 55139 of 2024 is modified to the extent indicated above. (Satyavrat Verma, J) SUMIT/- U T
