2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Bhagwan Bazar P.S. Case No. 518 of 2022 registered for the offences punishable under Sections 341, 323, 498-A, 504, 506 and 34 of the Indian Penal Code and Sections 3⁄4 of the D.P. Act.

3. The allegation against petitioner is to commit cruelty upon informant. Allegation of physical assault is also available against petitioner.

It is submitted by learned counsel appearing on behalf of the petitioner that process of amicable settlement has already been filed by the parties in the divorce petition, which is pending before Family Court, Patiala, New Delhi. It is pointed out that compromise petition has already been filed before learned Trial Court which now made available to this Court by way of

Patna High Court CR. MISC. No.72940 of 2023(10) dt.20-01-2026 2/2 affidavit and as this matter is pending before this Court since 2023, learned Trial Court is not entertaining the withdrawal petition.

5. Learned APP opposes the prayer of bail.

6. Despite service of notice, none appeared on behalf of O.P. No. 2.

In view of aforesaid factual submission and by taking note of fact as issues and differences prima-facie appears amicably settled between the parties, where compromise petition has already been filed in the present case, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Saran at Chapra/concerned Court, where the case is pending in connection with Bhagwan Bazar P.S. Case No. 518 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/ Section 482(2) of BNSS.
