Petitioner apprehend her arrest in connection with Patahi P.S. Case No. 80 of 2015 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 387, 436, 458, 504, 506 and 120B of the Indian Penal Code.
Allegation as per FIR is of setting on fire the office of the Construction Company and there was earlier demand of levy from the Construction Company and name of petitioner transpires during course of investigation.
Submission of learned counsel for the petitioner is that except confessional statement of co-accused there is nothing against the petitioner, who is a lady and statement of Guard also shows that only male members have come for setting on fire the
Patna High Court Cr.Misc. No.24257 of 2018 (2) dt.02-05-2018 2/2 office of Construction Company and not female member. Heard learned APP and from perusal of the record it appears that petitioner has been made accused in 19 other cases. Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner.
If petitioner surrenders and makes prayer for regular bail, the same shall be considered on the basis of materials available on record, without being prejudiced by this order. With the above observation, this application is disposed of.
