JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-04-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Buniyadganj P.S. Case No. 115 of 2022, registered for offence punishable under sections 147, 148, 149, 323, 326, 307, 354, 379, 504 and 506 of the Indian Penal Code. As per allegation, thirteen accused persons named in the FIR including the petitioner, surrounded the informant and his family members and started abusing them. At the order of Lallan Singh, co-accused Paltan Singh fired shot at Ranjan Kumar Singh and co-accused Kaushal Kumar Singh and Chandan Kumar fired shot on Anurudh Kumar Singh. Co-accused Amit Kumar Ranjan Tullu Singh assaulted the informant's nephew, namely, Amit Kumar and Rahul Kumar. The allegation against the petitioner and co-accused Sagar Yadav is that they locked the informant and his family members inside the house and bolted the door from outside.
The learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case and he is a person of clean antecedent. There is no specific allegation against him to assault anybody and his case is on exactly similar to the case of co-accused Sagar Kumar @ Sagar Yadav, who has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 63327 of 2022 and the petitioner is under custody since 23.08.2022.
Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Buniyadganj P.S. Case No.115 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
