2. The petitioner seeks regular bail in connection with Beur P.S. Case No. 369 of 2022 registered for the offence under Sections 377, 506 of the Indian Penal Code.

3. As per the prosecution case, the victim who was under trial was sodomized by the petitioner. The information was received by the police and the present case was filed.

4. Learned counsel for the petitioner submits that the informant has deposed partly and thereafter he is not appearing in the trial because of which, the trial is pending. The petitioner is in custody since 05.08.2022.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the serious allegations levelled against the petitioner and the fact that the crime is punishable up-to 10 years, I am not inclined to grant bail to the petitioner.

7. Accordingly, this application for regular bail is dismissed.

8. The Senior Superintendent of Police, Patna is directed to see to it that the informant and other victims are produced regularly in the trial.

9. Mr. Jharkhandi Upadhyay, learned APP will communicate this order to the Senior Superintendent of Police, Patna.

10. Let a copy of this order be communicated to the Senior Superintendent of Police, Patna through FAX for its compliance forthwith.
