2. The petitioner apprehends his arrest in connection with Govindganj P.S. Case No. 165 of 2023 registered for the offences punishable under Sections-379, 414/34 of the Indian Penal Code.
3. Allegedly, the informant having parked his motorcycle, went to watch Mahayagya, his motorcycle was stolen away by some unknown person.
4. Learned counsel for the petitioner has submitted that nothing was recovered from possession of the petitioner and he is a person of clean antecedent. His name has surfaced in this case on the basis of confessional statement of co-accused
Patna High Court CR. MISC. No.73331 of 2023(2) dt.09-11-2023 2/2 Mithilesh Sharma. Exactly on similar footing, the co-accused namely Tabrej Alam has been granted anticipatory bail by a coordinate bench of this court vide order dated 31-07-2023 passed in Cr. Misc. No. 42149 of 2023.
5. Learned Additional Public Prosecutor opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Govindganj P.S. Case No. 165 of 2023, subject to condition as laid down under section 438(2) Cr. P.C. (Nawneet Kumar Pandey, J) A.K.V.//- U T
