====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 05-02-2025 Heard Learned Senior Counsel for the petitioner and Learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Husainganj P.S. Case No. 162 of 2022 lodged on 21.06.2022, for the offences punishable under Sections 147, 341, 323, 324, 326, 504, 506, 302 of the Indian Penal Code.

3. Learned Senior Counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 27.02.2024 passed in Cr. Misc. No. 61198 of 2023. Senior Counsel further submits that in the rejection order, it has come that Trial Court has stated that within six months, trial shall be concluded. Senior Counsel submits that on earlier occasion, report with regard to the

Patna High Court CR. MISC. No.76835 of 2024(3) dt.05-02-2025 2/2 present stage of the trial has been called for and from the said report, it transpires that altogether nine witnesses including the I.O and doctor have been examined and case has been fixed for statement of accused persons on 24.12.2024. It has also been stated by the trial court that trial is likely to be concluded within a period of two months.

4. Learned APP for the State opposes the prayer for bail.

In this background, this Court restrain itself to pass any order on merit of the case, rather, directs to the Trial Court to conclude the trial in connection with Sessions Trial No.693 of 2022 arising out of Husainganj P.S. Case No.162 of 2022 within one month from today if, not concluded. If, the trial shall not be concluded within one month from the date of communication of this order, then in that case, petitioner shall be directed to be released on bail.

6. Accordingly, with the aforesaid direction, this bail application is hereby disposed off.
