2. The petitioner seeks regular bail in connection with Khaira P.S. Case No. 174 of 2025 for the offence registered under Section 30(a) of the Bihar Prohibition & Excise Act.

3. There is recovery of 17 litre illicit liquor from a plastic bag, kept in the grass behind the house of late Sudama Singh. Petitioner is alleged to have fled away from the spot.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case at the instance of Chaukidar. Petitioner has no concern with the seized liquor. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has one criminal antecedent which does not belong to Excise Act. He is

Patna High Court CR. MISC. No.71631 of 2025(2) dt.08-10-2025 2/2 in custody since 12.08.2025. Petitioner undertakes to co-operate in the trial.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.-3, Saran at Chapra in connection with Khaira P.S. Case No. 174 of 2025.
