JUSTICE SANJAY KUMAR ORAL ORDER 17-10-2017 Heard learned counsel appearing on behalf of the petitioners and learned Additional Public Prosecutor representing the State.

The petitioner apprehends arrest in connection with Chakand Police Station Case No. 84 of 2017 registered for the offences punishable under sections 341, 323, 354, 504, 379/34 of the Indian Penal Code.

It has been alleged that on 25.06.2017 altogether 5 FIR named accused teased the daughter-in-law of the informant. Co-accused Ajay Kumar snatched golden chain and ear ring from the possession of Purushottam Kumar and his sister (daughter-inlaw of the informant). This petitioner allegedly assaulted Purushottam Kumar by brick near his eye.

Heard both sides and on perusal of order passed by the

Patna High Court Cr.Misc. No.50241 of 2017 (2) dt.17-10-2017 2/2 Sessions Judge, Gaya in A.B.P. No. 1681 of 2017. It appears that other co-accused have been allowed anticipatory bail. The allegation of teasing the daughter-in-law of the informant is not specific against this petitioner, rather omnibus against all the accused persons.

Considering the facts and circumstances of the case, the prayer of anticipatory bail is allowed.

Let the above named petitioner in the event of arrest or surrender before the Court below within a period of six months from the date of receipt or production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Chakand Police Station Case No. 84 of 2017, subject to the condition as laid down under Section 438 (2) of the Criminal Procedure Code.
