====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 04-12-2024 Heard Mr. Manoj Kumar Singh, learned counsel appearing on behalf of the petitioner and Dr. Indiwar Kumari, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Gopalganj (Mahila) P.S. Case No. 05 of 2024 registered for the offence punishable under Sections 341, 323, 498-A, 406, 504, 506, 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

3. As per the allegation made in the FIR, it is alleged that the petitioner had tortured the informant, who is his wife, for non-fulfillment of demand of dowry.

4. Learned counsel appearing on behalf of the

No.79931 of 2024(2) dt.04-12-2024 2/3 petitioner has made specific statement in paragraph no. 7 of the bail application that he is ready to keep her wife with full honor and dignity and for the said purpose, he wants to reconcile his strained matrimonial relationship and he hopes that there is every possibility that the relationship can be established again by way of mediation.

5. Considering the aforesaid submission made on behalf of the petitioner, the matter is referred to the District Mediation Centre, Gopalganj. The parties are directed to appear before the Mediator on 22.01.2025 at 4.30 P.M.

6. Petitioner is directed to inform the opposite party no.2 by notice or by any means or through Court so that both the petitioner and the opposite party no.2 must appear on 22.01.2025 at 04:30 PM before the learned Mediator, District Mediation Centre. Learned District Court is also directed to take steps to issue notice to the opposite party no.2

7. Learned Mediator is directed to furnish report to the learned District Court within a period of four months.

8. The petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees

9. In case of failure of mediation, anticipatory bail granted to the petitioner by this Court shall lose its force automatically.

10. With the aforesaid observation and direction, the bail application stands disposed of.
