The petitioner seeks bail in connection with Dighwara P.S. Case No. 253 of 2025 instituted for the offence under Sections 191(2), 191(3), 190, 223, 126(2), 115(2), 118(1), 117(2), 118(2), 109, 125(b), 125(a), 324(4), 352, 351(2) & 61(2) of the Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution, in short, is that earlier there was some scuffle between children of two communities and for that, the family of the children started scuffling. It is alleged that both parties have sustained injuries. 4.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.71299 of 2025(3) dt.17-11-2025 2/3 that the petitioner is in custody since 03.07.2025. Petitioner bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no specific or direct allegation of any overt act against the petitioner rather the same is general and omnibus in nature. It is further submitted that the injuries sustained by the injured is simple in nature and only one injury of Saksham Kumar is found to be grievous in nature. Other co-accused have been granted bail by this Court vide order dated 16-10-2025, passed in Cr. Misc. No. 72781 of 2025.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no specific allegation against the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Dighwara P.S. Case
