The petitioner apprehends her arrest in connection with Ballia P.S. Case no. 240 of 2016, registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that in the late evening of 29.10.2016 Murlidhar Pashwan, husband of the informant, after taking the dinner left the house for sleeping at Dalan situated 40-50 meter away to the house. On the next morning, when informant reached at the Dalan then found her husband lying wound with blood. Further allegation of the informant is that before one day dispute was arose regarding the drain between her husband and Biltu Paswan, Pramod Paswan and Yugal Paswan and they had given threatening to her and her husband

Patna High Court Cr.Misc. No.29011 of 2018(2) dt.09-05-2018 2/2 for dire consequences. The informant raised suspicion that the aforesaid accused persons in connivance with the petitioner have committed the murder of her husband. The petitioner has also come to her house at 9.00 P.M. as a spy. Learned counsel for the petitioner submits that the petitioner is a lady and she has falsely been implicated in this case mere on the ground that she had visited at the house of the informant at 9.00 P.M. except that there is nothing against the petitioner. The petitioner is lady and she has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case No. 240 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
