The petitioner apprehends arrest in connection with G.R. No. 1657 of 2017 arising out of Bhagwan Bazar P.S. Case No. 84 of 2017 registered under Sections 323, 498A, 304B, 302, 201 and 34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner, who happens to be husband of the deceased, has falsely been implicated in this case. In fact, the deceased was suffering from heart disease. Further submission is that on perusal of paragraph-29 of the case diary, it appears that the deceased was treated in different Hospital and during the course of treatment, she died.

No.48579 of 2017 (3) dt.06-12-2017 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Chapra in connection with G.R. No. 1657 of 2017 arising out of Bhagwan Bazar P.S. Case No. 84 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
