The petitioners seek pre-arrest bail in connection with Deo P.S. Case No. 78 of 2019, registered under Section 366A/34 of the Indian Penal Code.

The accusation is of kidnapping of the informant by Nikesh Kumar, father, Arun Singh, mother Pramila Devi (petitioner no. 1), sister, Anshu Kumari (petitioner no. 2) in the way. The informant was served with one glass of liquid, thereafter, she became unconscious and found herself in the house of mausi of Nikesh Kumar, where forcibly her signature was obtained and her marriage was also performed with Nikesh Kumar.

Patna High Court CR. MISC. No.67854 of 2019(2) dt.31-01-2020 2/2 Submission is that both the petitioners are mother and unmarried sister of Nikesh Kumar and they have falsely been implicated in this case. In fact, Nikesh Kumar has performed marriage with the informant due to love affairs, but, later on, the informant in pressure of the parents lodged this case. Both the petitioners are ladies and have no criminal antecedent. Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Deo P.S. Case No. 78 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
