JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 This is an application for grant of anticipatory bail in connection with Haspura P. S. Case No. 238 of 2018, disclosing offences under Sections 147, 149, 151, 341, 342, 337, 307 and 353 of IPC and Sections 11(A) (e) of Prevention of Cruelty to Animal Act, 2016 and Sections 47, 48, 49, 51(i), 52, 54(i) (ii), 56(i) (ii) of Transportation Cattle Rules, 1978. As per F.I.R. one vehicle was intercepted by the police loaded with animals, the same has been brought from the police station where the villagers assembled and F.I.R. has been lodged against 09 known persons and against 10-15 unknown persons and they have attacked the police party and get the vehicle free from the custody of the police.

No.71551 of 2019(2) dt.08-11-2019 2/2 Submission of the learned counsel for the petitioners is that they have named in the F.I.R., but nothing specific has been attributed against them and considering the same, a Coordinate Bench of this Court, vide order dated 25.01.2019 passed in Criminal Misc. 79992 of 2018 allowed the anticipatory bail to the co-accused.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of lerned C.J.M., Aurangabad, in connection with Haspura P. S. Case No. 238 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
