The petitioner seeks bail in a case registered for the offence punishable under Sections 489 (A), 489 (B), 489 (c), 420, 414 & 34 of the Indian Penal Code.

The prosecution case in short is that on seeing the police, the accused persons stated fleeing away and on search counterfeit currency was recovered.

Learned counsel for the petitioner submits that the petitioner is in custody since 28.05.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge sheet has been submitted in this case. Counterfeit currency is said to have been recovered from the house of one Dina Nath Choudhary as per the seizure

Patna High Court CR. MISC. No. 65557 of 2019(2) dt.05-11-2019 2/2 list. The petitioner is said to be sitting at the house of the said Dina Nath Choudhary. He had no knowledge regarding the counterfeit notes being kept at the house of Dina Nath Choudhary. He has been falsely dragged in this case due to he is a driver of seized vehicle.

Learned counsel for the petitioner further submits that the co-accused has been granted bail by the Co-ordinate Bench of this Hon'ble Court in Cr. Misc. No. 55068 of 2019 dated 04.09.2019 Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- 1st, Bettiah, West Champaran, in connection with Bairiya P.S. Case No. 163 of 2019.
