The petitioner seeks regular bail in connection with Excise Case no.782 of 2017, Barbigha P.S.Case No.90 of 2016 registered for offences punishable under Sections 47(9) of the Excise Act.

Allegation against the petitioner is about recovery of 16 ltrs. of liquor from the house of the petitioner. He is accused in one more case.

Submission of the learned counsel for the petitioner is that the house is the joint house and he has falsely been implicated in this case and he is accused in one more case. Moreover he is in custody for three months. Charge sheet has been submitted . There is no chance of tampering with the

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. District and Sessions Judge, Shekhpura in connection with Barbigha P.S.Case No.90 of 2016 in Excise Case No.782 of 2016 with condition to co-operate in the disposal of the trial. With the aforesaid observation, this application is allowed.
