Petitioner is seeking anticipatory bail in connection with Complaint Case No.819 of 2015 registered for offences punishable under Section 406 of the Indian Penal Code. Learned counsel for the petitioner submits that the dispute between him and his brother who is related with the complainant led to filing of the present case. It is submitted that the complainant is a clerk in Mohania court and taking advantage of this position he has lodged the said case. He further submits that his client is ready and willing to provide appropriate security worth Rs.2,00,000/- in the court below subject to result of the case
Patna High Court Cr.Misc. No.53973 of 2017 (2) dt.09-11-2017 to show his bona fide and for purpose of present anticipatory bail. In the facts and circumstances of the case, in case of arrest or surrender of the petitioner in the court below in connection with the present complaint case within a period of four weeks from today, he shall be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Complaint Case No.819 of 2015 and deposit of appropriate security in form of documents of title relating to his immovable property worth Rs.2,00,000/- and on undertaking that he would not make any transaction with respect to the said security during the pendency of the case. It will be subject to the result of the present case.
The application is allowed accordingly.
