JUSTICE PURNENDU SINGH ORAL ORDER 01-05-2023 Heard Mr. Ram Adya Singh, learned counsel appearing on behalf of the petitioner and Mr. Surendra Prasad Singh, learned APP appearing on behalf of the State.
2. The petitioner apprehends his arrest in connection with Madhubani (Town) P.S. Case No. 169 of 2021 registered under Sections 147, 149, 323, 225, 333, 353, 186, 120B of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.
3. The prosecution story, in brief, is that the allegation made in the F.I.R is particularly against the petitioner is that petitioner along with the other co-accused persons tried to
Patna High Court CR. MISC. No.72725 of 2022(2) dt.01-05-2023 2/3 deceive the police officials to free the co-accused who has to be produced before the Court below in connection with Babubarhi P.S. Case No. 133 of 2021 ad Babubarhi P.S. Case No. 83 of 2021.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is a student and he is nowhere concerned with the alleged offence which had taken place in the Court premises. Learned counsel further submits that the name of the petitioner surfaced in course of investigation on the basis of confessional statement made by the co-accused.
5. Learned APP appearing on behalf of the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of allegation made in the F.I.R., the petitioner is a student and he has falsely been implicated in the present case, the Court below is directed to release the petitioner on anticipatory bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Madhubani (Town) P.S. Case No. 169 of 2021, subject to the condition as laid down under Section
Patna High Court CR. MISC. No.72725 of 2022(2) dt.01-05-2023 3/3 438(2) of the Cr.P.C.
