The petitioners apprehend their arrest in Islampur P.S. Case No. 166 of 2017 instituted for the offence under Sections 341, 323, 504, 506 and 307/34 of the Indian Penal Code. It is alleged in the written report that this petitioner and other accused persons have assaulted the wife of the informant with butt of pistol and iron rod with intention to kill and she sustained several injuries on her head, back, hands etc. due to which she fell down and became unconscious. This petitioner was armed with iron rod and other accused persons were armed with pistol, as mentioned in the written report.
Case diary has been received.
Patna High Court Cr.Misc. No.52349 of 2017 (4) dt.12-01-2018 2/2 The injury report of the wife of the informant is available in paragraph 23 of the case diary wherein it is mentioned that total six injuries have been sustained by the wife of the informant, out of which one injury was found to be grievous. From the injury report it appears that five injuries have been found on the parietal region and one injury was found on hand of the wife of the informant. The patient was referred to PMCH. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
