2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 109 and 3(5) of the BNS and Section 27 of the Arms Act. Later on Section 103(2) of the BNS was also added.
3. As per the prosecution case, it is alleged that the petitioner along with the other co-accused waved illegal pistol and opened fire at the deceased, leading to her death. It is alleged that the said pistol was brought by Sunil Yadav in which cartridge has been inserted by Bablu Yadav (petitioner).
4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. Specific allegation is against co-accused Vikas Yadav who
Patna High Court CR. MISC. No.70803 of 2025(3) dt.25-11-2025 2/2 fired upon the deceased. No specific overt act against this petitioner. Petitioner claims clean antecedent and is in custody since 28.05.2025. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Madhubani in connection with Basopatti P. S. Case No. 124 of 2024.
