JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 This is an application for grant of anticipatory bail in connection with N.T.P.C. P. S. Case No. 29 of 2019 disclosing offences under Sections 379 and 411 of the Indian Penal Code. As per prosecution case some miscreants were engaged in the theft of copper cable, the CISF personnel chased them, three accused persons succeeded in fleeing away from the spot and one was arrested on the spot, who disclosed the name of the petitioner.

Submission of the learned counsel for the petitioner is that except confessional statement of the co-accused, there is nothing against him. No recovery was made from his possession and he has no criminal antecedent.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.68314 of 2019(3) dt.10-01-2020 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Bhagalpur, in connection with N.T.P.C. P. S. Case No. 29 of 2019.
