Petitioners apprehend arrest in connection with Lauriya Police Station Case No. 214 of 2016 registered for the offences under sections 304B/201/34 of the Indian Penal Code. It has been submitted that the deceased died on account of diarrhea and the petitioners have been falsely implicated at the instance of persons who are at inimical terms with the family members of the petitioners. The husband of the deceased is in custody. The petitioner no. 1 is mother-in-law and petitioner no. 2 is Debar of the deceased. Except the informant, none of the family members have supported the allegation of
Patna High Court Cr.Misc. No.57155 of 2017 (3) dt.01-02-2018 2/2 demand and committing murder of the deceased. The deceased died on account of diarrhea which is apparent from the statement of witnesses and family members of the informant. The father-inlaw of the deceased has already been allowed regular bail by one of the coordinate Bench of this Court in Cr. Misc. No. 36345 of 2017 on 04.10.2017. The petitioners have clean antecedent. The learned Additional Public Prosecutor on the other hand, opposed the submission.
Considering the facts and circumstances of the case, the prayer for bail is allowed and the above named petitioners in the event of arrest or surrender before the learned court below within six weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Lauriya Police Station Case No. 214 of 2016, subject to conditions as laid down under section 438(2) Cr.P.C.
