2. The petitioner seeks bail in connection with Sugauli P.S. Case No. 430/2025 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. As per the prosecution case, the petitioner was involved in selling of country-made liquor. When the police conducted raid, the petitioner along with other accused persons tried to flee on a motorcycle but the police apprehended them and on search, total 45 liters of country-made liquor was recovered.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the

Learned counsel further submits that no incriminating article has been recovered from the possession of the petitioner and the petitioner has no concern about the present prosecution. Learned counsel further submits that petitioner has one criminal antecedent and he is in custody since 08.08.2025.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of Exclusive Special Excise Court-1, East Champaran at Motihari in connection with Sugauli P.S. Case No. 430 of 2025.
