JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Bath P.S. Case no. 74 of 2017, registered under Sections 452, 323, 307, 379, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that on 25.06.2017 at about 10.00 P.M. petitioners along with Dilip Yadav came at the door of the informant Kishori Mandal and made enquiry about his son Nitish Kumar and entered in the house. Thereafter, all caused injury to his son Nitish Kumar at his head through lathi and stick. When Satish Kumar, younger son of informant, rushed to save him then he was also assaulted by them.

Learned counsel for the petitioners submits that due to

Patna High Court Cr.Misc. No.54500 of 2017 (2) dt.16-11-2017 2/2 some dispute scuffle took place in between the petitioners and informant. Further submission is that injuries as found on the person of the both sons of the informant are simple in nature. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Bath P.S. Case No. 74 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
