====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 22-10-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 307 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that on 28.06.2017 at the time of marriage of informant's sister with bridegroom Vikash Kumar, the informant and other relatives were at the door and were talking. At about 1.20 A.M. in the night, the informant heard the sound of firing and fired cartridge hit on the wall and on hearing the sound of firing, the persons present

No.64722 of 2019(2) dt.22-10-2019 2/3 there started fleeing hither and thither and females who present there, saw Chandradeep Yadav (petitioner) having Katta in his hand was fleeing. On query, the females stated that the petitioner fired from the heap of straw. The informant also claimed that the petitioner fired with Katta over him with intention to kill him.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 08.06.2019. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is neighbour of the informant. Due to previous enmity, the present case has been instituted. None is said to have been injured in course of occurrence. Other accused has been granted bail by this Court vide Cr. Misc. No. 30286 of 2019 under order dated 23.04.2019. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.,
