JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-05-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks pre-arrest bail in connection with Barun P.S. Case No.69 of 2018 registered for the offences under Sections 379, 42034 of I.P.C. and 4/40 of Bihar Mines Act and 15 of Prevention of Population Act.

Accusation is that in course of raid 35 tractors attached with tailers were seen loaded with sand by the police party but the drivers of the said tractors accelerated the tractors and after unloading 29 tractors including the tractor of the petitioner were found later on parked.

Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.29633 of 2018 (2) dt.14-05-2018 2/2 submits that it would appear from the F.I.R. that the tractor of the petitioner was found parked without loading sand in cattle fare which was seized by the police.

Having considered the facts and the circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Aurangabad, in Barun P.S. Case No.69 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Rajendra Kumar Mishra, J) AnilKrSinha/- U
