JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-10-2024 Though the present writ petition has been filed for quashing the notices dated 21.09.2024 and 27.04.2023, issued by the Circle Officer, Goraul (Vaishali), in connection with Encroachment Case No.05 of 2023-24, however, at the outset, the learned counsel for the petitioners submits that the petitioners have filed a title suit, bearing Title Suit No.877 of 2023, which is pending consideration before the learned Court of Sub-Judge-XVII, Vaishali at Hajipur, hence it is prayed that some interim protection be granted to the petitioners in order to

Having regard to the limited prayer made by the petitioners in the present case, I deem it fit and proper to dispose off the present writ petition with a direction to the respondents to maintain status quo, existing as on today, qua the land/house of the petitioners in question, for a period of six weeks from today, in order to enable the petitioners to obtain stay order/injunction in the pending Title Suit No.877 of 2023.
