2. The petitioner seeks bail in connection with Mairwa P.S.Case No. 91 of 2016 instituted for the offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The prosecution case in short is that four unknown persons came at the shop of informant and fired on the informant and his brother by pistol. The informant received gut shot injury of his stomach and thereafter all the four unknown persons fled away riding on the motorcycles. 4 Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Patna High Court CR. MISC. No.75743 of 2023(3) dt.28-02-2024 2/2 is not named in the FIR. During the investigation, on the basis of confessional statement of co-accused Numan Akhtar, the name of petitioner has transpired in this case. The petitioner has not been put on TIP till now. The petitioner is in custody since 04.05.2023 and he has got three criminal antecedent. CoAccused Numan Akhtar has already been granted bail by a coordinate bench of this Court in Cr. Misc. No.26041 vide order dated 25.10.2016

Considering the facts and circumstances of the case and also co-accused Numan Akhtar has already been granted bail, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, -VII, Siwan in connection with Mairwa P.S.Case No. 91 of 2016, (Ramesh Chand Malviya, J) N.K/- U T
