====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------- 15-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bikram P.S. Case No.67 of 2017 registered under Sections 341, 323, 354(A)(D) and 504 of the Indian Penal Code. The accusation is that in the evening of 16.03.2017, the sister of the informant had gone to canal to take goat. In the meantime, his villager Mantosh Das (petitioner) caught hold of the hand of the sister of the informant with bad intention. When the sister of the informant started to cry, the mother of the informant reached there and, thereafter, the petitioner caused assault to the sister and mother of the informant through fists and slaps.

Patna High Court Cr.Misc. No.54163 of 2017 (2) dt.15-11-2017 2/2 Learned counsel for the petitioner submits that the petitioner and the informant are co-villagers. In fact, the dispute took place in between the parties due to grazing of the goat in the field and the informant has lodged this false case. Moreover, the petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Danapur, Patna, in connection with Bikram P.S. Case No.67 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
