JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 This is an application for grant of anticipatory bail in connection with Hajipur Sadar P.S. Case No. 536 of 2017, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act.

As per F.I.R. there is allegation of recovery of 52 liters of liquor from the house of one Ramadhar Sahni and it is said that petitioner and other accused has kept the liquor there. It further appears that petitioner is an accused in two other similar type of cases.

Submission of the learned counsel for the petitioner is that recovery is not from the house of the petitioner. He has falsely been implicated in this case. Further submission is that earlier he has no information about the same. Heard learned A.P.P. also who has opposed the prayer for anticipatory bail.

No.64923 of 2019(2) dt.18-10-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, as the petitioner is named in the F.I.R. and further he is accused in two other cases, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender and pray for regular bail before the learned court below, the same shall be considered on its own merit, without being prejudiced by order of this Court.
