2. Petitioner seeks regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act.

3. On getting secret information that the petitioner is manufacturing and selling illicit liquor in her house, the police party conducted raid. On seeing the police party, the petitioner started fleeing away from the place of occurrence but she was apprehended on the spot. On search, 11 litres country made liquor as well as 1000 litres semi prepared liquor was recovered from the asbestos house of petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

Patna High Court CR. MISC. No.70413 of 2025(2) dt.26-09-2025 2/2 case due to ulterior motive. Nothing has been recovered from conscious possession of the petitioner. Petitioner has no concern with the seized liquor. The alleged recovery has been made from the hut which does not belong to the petitioner. Petitioner, who is a lady, is in jail since 08.08.2025 having no criminal antecedent and she undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case, the submissions of the parties and period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise, Court No.1, East Champaran at Motihari in connection with Muffasil Motihari P.S.
