JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2017 Learned counsel for the petitioner has filed a supplementary affidavit and he is permitted to make necessary correction in the petition in the course of the day. Heard learned counsel for the petitioner.

This is an application for bail in connection with Bounsi P.S.Case No. 218 of 2017 registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act. Allegation is of recovery of 300 litres of liquor from two vehicles and petitioner and others have been arrested at the spot. Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he is in custody since 11.9.2017, having no criminal antecedent of similar type and other similarly situated co-accused have been granted

Patna High Court Cr.Misc. No.55222 of 2017 (2) dt.20-11-2017 2/2 bail in Cr.Misc.No. 50794 of 2017 and in Cr.Misc.No.51460 of 2017 by co-ordinate Benches of this Court.

Having heard both sides and considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Banka, in connection with Bounsi P.S.Case No. 218 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court, failing which his bail bond shall be cancelled.
