JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2018 Petitioners apprehend their arrest in connection with Maranchi P.S.Case No. 22 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 353, 385, 386, 393 and 504 of the Indian Penal Code.

Allegation as per FIR is that police intercepted petitioner No.1 in drunken condition and his family members forcible got him fled from the place of occurrence.

Submission of learned counsel for the petitioners is that no case was registered against petitioner No.1 earlier and so far petitioner No.2 is concerned, no specific allegation is attributed against him. Further submission is that co-accused persons have been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 23.5.2018 passed in Cr.Misc.No. 32135 of 2018.

Having heard both sides and in the facts and circumstances, let the petitioner No.2, named above, in the event of his arrest or surrender be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Deepak Kumar, Additional Chief Judicial Magistrate-cum-Sub Judge-IV, Barh, Patna, in connection with Maranchi P.S.Case No. 22 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned. So far petitioner No.1 is concerned, he should surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order. With the above observation, this application is disposed of.
