1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Naugachia P.S. Case no. 213 of 2024 registered under sections 457 and 380 of the Indian Penal Code.

3. As per the prosecution case, the informant states that hearing some sound, on waking up late in the night she saw the accused persons including the petitioner herein committing theft. On hulla being raised it is stated that they escaped. Information was given to the police.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case because of enmity between the parties. The same would be evident from the fact that for an occurrence said to have taken place on

Patna High Court CR. MISC. No.74835 of 2024(2) dt.12-11-2024 2/2 24.6.2024, besides the written statement being nicely typed, inspite of the police station being at a distance of only 5 kms, information was given at the police station 5 days later on 29.6.2024. The petitioner has no criminal antecedent.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegation in the F.I.R. and the submissions made on behalf of the petitioner especially on the point of delay together with the petitioner not having any criminal antecedent, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Naugachia P.S. Case no. 213 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned First Additional Chief Judicial Magistrate, Naugachia, District-Bhagalpur.
