KUMAR ORAL ORDER 24-05-2018 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners are apprehending their arrest in connection with Gaurichak P.S. Case No. 02 of 2018, registered for offences punishable under Sections 379 and 427/34 of the Indian Penal Code.
The prosecution case as lodged by the informant is that there is a title suit, which is pending between the parties with respect to the ancestral land in question, for which, the allegation of theft has been alleged by the informant in the F.I.R. Learned counsel for the petitioners submit that the
Patna High Court Cr.Misc. No.31203 of 2018 (2) dt.24-05-2018 petitioners have falsely been implicated in this case and there are general and omnibus allegation have been attributed against all the petitioners.
Considering the aforesaid facts, the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) each with two sureties of the like amount each in connection with Gaurichak P.S. Case No.02 of 2018 to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Patna City, subject to the condition laid down under Section 438
(2) of the Criminal Procedure Code.
