JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-11-2019 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest for the offences alleged under Sections 147, 148, 323, 342, 353, 332, 333, 337, 338, 427 and 152 of the Indian Penal Code registered in connection with Durgawati P.S. Case No. 131 of 2019.

The allegation against the petitioners, as per the first information report, is that the Sub-Inspector of Police Suhail Ahmad received information that near the sweet shop of Ranu Gupta at village, two groups are fighting to each other and when the police personnel reached there and tried to pacify the matter, both parties

Patna High Court CR. MISC. No.65523 of 2019(2) dt.13-11-2019 2/2 became violent for scuffle and they started abusing and pelting stones upon the police personnel in which police vehicle was damaged and the police personnel received injuries. Learned counsel for the petitioners submits that the petitioners have not been named in the FIR. He further submits that the petitioners have been falsely implicated in the case due to village politics. He further submits that the persons named in the FIR have been granted anticipatory bail by a coordinate Bench of this Court vide order dated 19.07.2019 passed in Cr. Misc. No. 44469 of 2019.

In the facts and circumstances of the case, in the event of the petitioners' arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Durgawati P.S. Case No. 131 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
