04-12-2017 Heard Sri Brij Nandan Prasad, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 25-06-2017 in Amarpur P.S. Case No. 256 of 2017 registered for offence under Sections 30(a) & 38(2) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.
By way of referring to statement made in paragraph - 3 of the petition, learned counsel for the petitioner submits that petitioner is having clean antecedent. It has further been argued that nothing was recovered from conscious possession of the petitioner or from his house, rather in the case, from a lane, huge quantity of country-made liquor was shown to be recovered and falsely, petitioner was apprehended and he is languishing in jail since 25-06-2017.

Bablu @ Md. Babloo be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - II, Banka in connection with Amarpur P.S. Case No. 256 of 2017.
