Petitioner apprehends his arrest in connection with L.N.M.U. P.S.Case No. 92 of 2016 registered for the offences punishable under Sections 420, 409, 467, 468, 471 and 120B of the Indian Penal Code.

Allegation against the petitioner is of financial irregularity in the B.S.R.T.C. and petitioner is cashier in B.S.R.T.C.

Submission of learned counsel for the petitioner is that enquiry report itself shows that there is no defalcation rather it is a case of financial irregularity and petitioner is not named in the

Patna High Court Cr.Misc. No.38527 of 2018 (3) dt.16-07-2018 2/2 FIR. Further submission is that other co-accused persons have been granted privilege of anticipatory bail vide order dated 28.2.2018 passed in Cr.Misc.No. 6733 of 2018 and vide order dated 11.4.2018 passed in Cr.Misc.No. 28412 of 2017. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with L.N.M.U. P.S.Case No. 92 of 2016, G.R.No. 1089 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
