JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-01-2025 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the opposite party No. 2.
2. The petitioner apprehends his arrest in a case registered under Sections 341, 323, 324, 307, 448. 504, 34 of the Indian Penal Code and Section 8 of the POCSO Act.
3. As per F.I.R., this petitioner attempted to undress the daughter of informant.
4. Learned counsel appearing on behalf of the petitioner submits that informant and co-accused Shashi Bhushan Mahto are full brothers and this petitioner has been falsely implicated
Patna High Court CR. MISC. No.77112 of 2024(2) dt.18-01-2025 2/2 in this case merely because he happens to be tempo driver of coaccused Shashi Bhushan Mahto. There is no allegation of assault against this petitioner. Petitioner is a man of clean antecedent.
5. Learned A.P.P. for the State and learned counsel for the O.P. No. 2 opposed the prayer for bail.
6. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge POCSO Court, Saran at Chapra, in connection with Bhagwan Bazar P.S. Case No. 219 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
